OFFICIAL RULES – Scratch for Your Fate Contest

The following Official Rules (the “Rules”) govern the Scratch for Your Fate Contest (the “Contest”) sponsored by Newton Running Company, a corporation with place of business at 1375 Walnut Street, Suite 100, Boulder, CO 80302 ("Newton" or “Sponsor”).

Eligibility

No purchase necessary.  To be eligible to enter, you (“Entrant”) must be a legal U.S. resident 18 years of age or older.  Residents of Rhode Island are not eligible to enter.  Employees of Newton are not eligible to enter.  This Contest is void where prohibited. 

By participating in the Contest, Entrant represents and warrants that he/she has read and understood, and fully and unconditionally agrees to and accepts, these Official Rules and that the decisions of the Sponsor are final and binding in all matters related to the Contest. Winning any prize is contingent upon fulfilling all requirements set forth herein.  By participating in the Contest, Entrant consents to disclosure of his or her name should Entrant win a prize.

How to Enter

No purchase is required to enter or win the Contest.  Individuals may enter by attending a participating Newton Running event (an “Entry Event”) to receive a free Contest entry card; the list of Entry Events is available at http://www.newtonrunning.com/community/form-clinics 

Entry cards are limited, and no rain checks or additional entry cards will be issued once the initial supply of entry cards is exhausted.

Each entrant may request and redeem only one entry card per Entry Event during the Contest Period.

Winner Selection

The Contest begins on June 20th, 2014 at 12:00 AM EST and ends on July 20th, 2014 at 11:59 PM EST (the “Contest Period”).

Entrants may enter the contest by scratching off the foil on an entry card.  If the entry card reveals a prize, the entrant has won the displayed prize.  All winning entries must be redeemed immediately by showing the card to a Newton representative at the Entry Event.  The Newton representative will then submit an order, which will be shipped to the winner’s home in the continental United States at Newton’s cost.

For a statement of the identification of the winners in the Contest, send a self- addressed, stamped envelope, making a request to receive such information, to: “Scratch for Your Fate Contest Winner List Request – Attn: Thom Ward – 1375 Walnut St, Ste 100, Boulder, CO 80302.” Such requests must be received by August 20th, 2014.

Prize Details

A winning scratch card will award one of the following prizes:

  • One Newton Jacket, MSRP: $90.  Odds of winning 1:100.
  • One pair of Newton Running Shoes (winner’s choice of Fate or Kismet models) MSRP: $129.  Odds of winning 1:100.
  • One pair of Newton socks, MSRP: $10. Odds of winning 1:9.
  • One Newton hat or visor. MSRP: $20 value. Odds of winning 1:50.

Additional provisions:

These Official Rules are governed by the laws of Colorado. Entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded or not awarded shall be resolved solely individually, without resort to any form of class action, and exclusively in the federal and state courts of the county of Boulder or Denver, Colorado. All issues and questions concerning the construction, validity, interpretation, or enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules that would result in the application of the laws of any other jurisdiction.

Newton reserves the right to cancel, suspend or modify the Contest if any problem prevents the Contest from being conducted as planned.

By submitting an entry, entrant agrees to release and hold Newton harmless from and against any claim associated with the Contest.

Newton is not responsible and cannot be held liable for technical errors or anything that may prevent the Contest from being conducted as planned.

Newton reserves the right to substitute any prize with another prize of equal or greater value if the advertised prize is not available.
