TEAM NEWTON RUNNING IMC | RACE ENTRY TERMS & CONDITIONS
VOID WHERE PROHIBITED BY LAW.
  1. DEFINITIONS. For purposes of these Terms and Conditions, the following definitions shall apply:

    “Newton” shall mean Newton Running Company located at 1300 Walnut St., Suite 100, Boulder, CO 80302.

    “Team Newton” shall mean the team organized by Newton to raise money for The Prostate Cancer Foundation through Athletes for a Cure (“AFAC”).

    “IMC” shall mean the Subaru Ironman Canada race on August 26, 2012.
  2. “Required Documents” shall mean the Affidavit of Eligibility, Publicity Release and Liability Waiver” located at http://www.pcf.org/faf/home/waiver.asp?ievent=1013680.
  3. ENTRY PERIOD. The Entry Period will begin on March 8, 2012 and will end on July 1, 2012 at midnight (the "Entry Period") with Mountain Time controlling for all purposes.
  4. ELIGIBILITY. Anyone over eighteen (18) years of age is eligible.

    LIMIT OF ONE (1) ENTRY PER PERSON. In order to participate in Team Newton you must comply with the following:

    (1) Donation to AFAC: i) visit http://www.pcf.org/faf/home/waiver.asp?ievent=1013680&lis=1&kntae1013680=D07A321933434ED5899CB7D6823D5DC9 and make a gift of a minimum of $3500 to The Prostate Cancer Foundation through AFAC Team Newton; or (ii) commit to raising a minimum of $3,500 for the Prostate Cancer Foundation in accordance with the terms and conditions at http://www.pcf.org/faf/home/waiver.asp?ievent=1013680&lis=1&kntae1013680=3740F4410AC3469090EC433E96122181#

    (2) Any entry that is late will not be accepted. An eligible participant who submits a properly completed entry in accordance with this paragraph within the Entry Period is considered a "Participant." All entries become the property of the Newton and will not be acknowledged or returned. By submitting an entry, the Participant acknowledges that he or she has read and understands these Terms and Conditions and agrees that he or she shall be bound by these Terms and Conditions.
  5. GENERAL. Participant will receive the following:

    a. 1 (one) entry into IMC as a member of Team Newton;
    b. one pair of Newton Performance Trainers;
    c. one pair of Newton Performance Racers;
    d. Team Newton clothing, bibs and race kit;
    f. Team Newton dinner;
    g. VIP bands for IMC events

    Participant must sign all the documents required by AFAC within the time specified in order to receive an entry. All necessary transportation and/or accommodations are solely the responsibility of Participant. Participant is responsible for any and all other expenses including, but not limited to, meals, beverages, transportation, parking and personal purchases. No responsibility is assumed by Newton for cancelled, delayed, suspended or rescheduled events. No groups, clubs, or organizations may participate in this offer or reproduce or distribute any portion of these rules or entries to their members.
  6. LIMITATIONS ON LIABILITY. By entering, Participant agrees to HOLD HARMLESS AND INDEMNIFY Newton and its respective partners, parents, subsidiaries, affiliates, directors, officers, governors, employees, and agents (the "Released Parties") from any and all liability, damages, claims and causes of action (however named or described) with respect to or arising out of (a) participation in Team Newton or IMC or while traveling to or from any related activity, or (b) the receipt and/or use of any product or service by Participant that may be provided by Newton.
  7. CONSENT OF USE. Participant hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the publication of Participant’s name, likeness, photograph, voice, entry and the like in any medium, whether now known or hereafter developed, including, without limitation, Newton’s website and in any and all advertising, promotions, and other publicity conducted by Newton, and its respective partners, parents, subsidiaries, affiliates, directors, officers, owners, governors, employees, and agents, except where prohibited by law.
  8. MODIFICATIONS. All modifications of these Terms and Conditions are exclusively within the sole discretion of Newton and may be changed from time to time without notice.
  9. DISPUTES. Participant agrees that any dispute or cause of action arising out of or connected with Team Newton shall be resolved individually, without resort to any form of class action, and exclusively by arbitration, which will be conducted in Boulder, Colorado, in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
  10. FORCE MAJEURE. Newton shall not be responsible for the cancellation or postponement of any part of Team Newton or IMC for any reason including, but not limited to, cancellation of IMC, or any act of God or other "force majeure" event.

What's the Buzz?

  • Just a few lines to let you know that I had a wonderful race in San Sebastian marathon (Spain) two weeks ago. I ran in 2:30 in my Newton shoes. I'm from the Basque country in Spain and everybody is asking me what shoes are these. I'm the first guy running in these shoes around here. I've done all my previous long runs wearing them and cushioning is just exceptional. I had No blisters or signs of a marathon after the race. Obviously I'm ready for a new pair for my next event. Congratulations you've got a great weapon for runners.
